These Terms and Conditions ("Terms") govern your use of the Brisbane Port Tyres platform ("Service") operated by Brisbane Port Tyres, a subsidiary of SEQH Group ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.
"Member" means a business entity that has registered for and maintains an active annual membership with the Container Buying Club.
"Container Deal" means a collective purchasing opportunity for tyres shipped in full containers, available exclusively to Members.
"Pledge" means a Member's commitment to purchase a specified quantity of tyres from a Container Deal.
"Retail Purchase" means the purchase of individual tyres from available stock, outside of Container Deals.
Membership is available only to registered Australian businesses with a valid Australian Business Number (ABN). You must provide accurate business information during registration, including your ABN, business name, and contact details.
All membership applications are subject to approval by Brisbane Port Tyres. We reserve the right to accept or reject any application at our sole discretion. Approval typically occurs within 2-3 business days of application submission.
The annual membership fee is $299 AUD (including GST) and is payable in advance. Membership fees are non-refundable except as required by Australian Consumer Law. Membership renews automatically unless cancelled at least 30 days before the renewal date.
Active Members receive:
Members may pledge to purchase quantities of tyres from available Container Deals. Pledges are binding commitments to purchase the specified quantity at the advertised price, subject to container fill completion.
Container Deals proceed only when the container reaches 100% capacity through Member pledges. If a container does not fill within the specified timeframe (typically 90 days), pledges may be cancelled and Members will be notified.
Payment for Container Deal pledges is due when the container reaches 100% capacity and is confirmed for shipment. Members will receive a payment request via email and must complete payment within 7 days. Accepted payment methods include bank transfer, credit card (via phone), and 30-day invoice for approved businesses.
All Container Deal orders must be collected from the Port of Brisbane facility within 14 days of arrival notification. Storage fees may apply for delayed collection beyond this period.
Retail tyre purchases are available for immediate purchase subject to stock availability. Member pricing applies automatically to active Members. Payment is required at time of order. Retail orders are available for collection at Port of Brisbane or delivery may be arranged for an additional fee.
All prices are in Australian Dollars (AUD) and include GST unless otherwise stated. We reserve the right to change prices at any time, but price changes will not affect existing confirmed orders or pledges.
We accept bank transfer, credit card (via phone), and 30-day invoice terms for approved businesses. Payment must be received in full before goods are released for collection.
Late payment fees may apply for invoice payments not received within 30 days. We reserve the right to suspend membership benefits for accounts with overdue payments.
All tyres supplied are new, premium quality products backed by manufacturer warranties. Specific warranty terms vary by brand and will be provided with your purchase. We guarantee that all products meet Australian Design Rules (ADR) and safety standards.
Due to the nature of collective purchasing, Container Deal pledges cannot be cancelled once the container reaches 50% capacity. Retail purchases may be returned within 14 days if unopened and in original packaging, subject to a 15% restocking fee.
If products are faulty or do not match the description, you are entitled to a replacement or refund under Australian Consumer Law. Claims must be made within 7 days of collection with photographic evidence.
To the maximum extent permitted by law, Brisbane Port Tyres and SEQH Group shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service or purchase of products. Our total liability for any claim shall not exceed the amount paid by you for the specific product or service giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Australian Consumer Law.
All content on the Service, including text, graphics, logos, and software, is the property of Brisbane Port Tyres or its licensors and is protected by Australian and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.
We may suspend or terminate your membership at any time if you breach these Terms or engage in fraudulent or illegal activity. You may cancel your membership at any time by providing 30 days written notice, but membership fees are non-refundable for the current membership period.
These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Queensland.
We reserve the right to modify these Terms at any time. We will notify Members of significant changes via email. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
